Regulations
The
legislation of the Republic of Latvia stipulates that the owner of the
online store must determine the terms of delivery and return of the
goods, as well as the right of withdrawal. Such a reservation is called a
distance contract (Cabinet Regulations).
Distance contract
The
Seller of the goods offered in this Online Store, on the one hand,
hereinafter referred to as the Seller, and the person performing the
Order, hereinafter called the Buyer, on the other hand, shall conclude
the following Agreement:
The Seller undertakes to sell and deliver the Goods to the Buyer in accordance with the Buyer's order.
Delivery and payment arrangements
The
buyer orders the goods through this website, indicating the type and
quantity of the goods to be ordered. The Buyer has the opportunity to
pay for the goods by using the payment tools embedded in the Internet
shop or by paying the invoice corresponding to the order prepared by the
Seller and sent to the Buyer by e-mail. The invoice is prepared
electronically and is valid without signature.
The Seller shall
ensure the delivery of the goods within 5 days after the receipt of the
payment for the goods, with the delivery time agreed with the Buyer.
Right of withdrawal
The
Buyer has the right to refuse the goods within 14 calendar days from
the moment of receiving the Goods by sending the Seller a letter of
refusal on e-mail [email protected]. The Seller shall send the letter of withdrawal to the Buyer by
e-mail at the Buyer's request.
The Buyer is obliged to return the
goods to the Seller within 7 days after sending the withdrawal letter.
All expenses incurred in returning the product to the Seller shall be
borne by the Buyer.
The buyer may not exercise the right of withdrawal if:
- the goods ordered cannot by their nature be returned, they are perishable or are quickly used;
- the ordered goods are made directly to the Buyer on individual order;
- the buyer has opened audio or video recordings or software packages.
Article
12 (6) of the Republic of Latvia Law on Consumer Protection states that
"the consumer shall be responsible for maintaining the quality and
safety of the product within the term of exercising the right of
withdrawal". The Seller reserves the right to refuse the Buyer the right
to refuse or withhold compensation in the event of damage to the
product, inappropriate handling of the product during use, or failure to
comply with the instructions if the original packaging of the product
is lost or if its packaging is seriously damaged.
Data processing
By entering the required information, drawing up an order, the Buyer confirms that he / she has read and agrees that the data provided by him / her is used to allow the Seller to accept the Buyer's order and to deliver the goods in accordance with the requirements of Latvian legislation. By entering the information, the Buyer agrees to receive notifications related to the processing of the Buyer's order.
Privacy Policy
1. General Privacy Policy of PROBAR:
1.1
These privacy rules (hereinafter referred to as "the Terms") regulate
the basic principles and procedures of the internet shop PROBAR
(hereinafter referred to as "the Seller"), which the client (hereinafter
referred to as the "Buyer") shall observe.
1.2. Persons under the age of 18 may only purchase at the online store with the consent of their parents or guardian.
2. Terms of Registration:
2.1 PROBAR registration form includes complete, comprehensive and
accurate information about the Buyer. If inaccurate, false or misleading
information is provided in the registration form, the Seller has the
right to cancel the Buyer's registration and delete the data, or
restrict the Buyer's access to the PROBAR online store.
2.2 PROBAR online store collects and uses data of natural persons (name,
address, phone number, e-mail address and other information included in
the registration form of PROBAR) to:
a) process and approve the Buyer's order;
b) solving problems related to order or delivery;
c) fulfill other contractual obligations.
2.3
Personal data is managed by following security measures, protecting
information from unauthorized destruction, disclosure to third parties
or other illegal activities.
2.4 Other information that does not
correspond to personal data, such as data related to the goods purchased
by the Buyer, may be used by the Seller for statistical purposes. The
data collection process does not reveal the identity of the buyer. The
Seller reserves the right to use the statistical data as well as to
transfer it to third parties.
3. Transfer of personal data to third parties:
3.1 PROBAR reserves the right to transfer information to third parties
only from the purposes of paragraph 2.2 in paragraph 2.
3.2 Payment processing is provided by the payment platform makecommerce.lv, therefore PROBAR transfers the personal data necessary for the execution of payments to the platform owner Maksekeskus AS.
3.3 PROBAR undertakes not to disclose your personal data to third parties
without your consent, except under the conditions prescribed by law.
4. Changes or Updates to Personal Data:
4.1 The buyer has the right to change, update and delete his personal data by sending a request to the e-mail [email protected].
4.2 The Seller needs complete, detailed and up-to-date information about the Buyer to effectively perform his / her business.
5. Questions and Claims:
5.1 All information regarding the exchange of personal data must be submitted by e-mail: [email protected]
5.2 After receiving the notification, the Buyer will receive a reply in his / her e-mail.
6. Processing of personal data:
6.1. Under these terms, the Buyer agrees to the use of personal data.
7. Change of Terms:
7.1 PROBAR reserves the right to partially or completely change the privacy policy.
7.2. If you use PROBAR online store services, we assume that you have agreed to the privacy policy.
8.Final provisions
8.1 These Privacy Policy Terms and Conditions apply to the rights of the Republic of Latvia.
8.2
Any discrepancies arising in the event of non-compliance with the law
shall be settled by negotiation. In case of disagreement, disagreements
shall be resolved according to the procedures specified in the laws of
the Republic of Latvia.
